§ 1 Scope

(1) These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between

(hereinafter "Seller") and the customer (hereinafter "Customer") in the version valid at the time of the order.

(2) The GTC apply to the sale of food supplements and related products via the online shop at highbalancenutrition.com.

(3) Deviating conditions of the customer are not recognized, unless the seller expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

(1) The product presentations in the online shop do not constitute a legally binding offer, but an invitation to place an order.

(2) The customer can place products in the shopping cart without obligation and correct their entries at any time before submitting the binding order. The contract is concluded when the customer places the order by clicking the order button and this is accepted by the seller with an order confirmation email.

§ 3 Prices and Payment

(1) All prices quoted are final prices. According to § 19 UStG, no sales tax is charged (small business regulation).

(2) Payment is made via the payment methods offered in the Shopify checkout, including:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Klarna
  • Apple Pay
  • Google Pay
  • Shop Pay

§ 4 Delivery and Shipping

(1) Shipping takes place to the delivery address specified by the customer.

(2) The delivery time is 3–7 working days within Germany. For deliveries to other European countries, 5–14 working days.

§ 5 Right of Withdrawal

Consumers have a statutory right of withdrawal. Further information can be found in our cancellation policy.

§ 6 Retention of Title

The delivered goods remain the property of the seller until full payment.

§ 7 Warranty and Liability

(1) The statutory warranty rights apply.

(2) The seller is liable without limitation for intent and gross negligence as well as according to the Product Liability Act.

§ 8 Special Notes on Food Supplements

(1) Food supplements are not a substitute for a balanced diet and healthy lifestyle.

(2) The recommended daily dose must not be exceeded.

(3) Keep out of reach of small children.

§ 9 Data Protection

§ 10 Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall not be affected.
